The Kerala High Court has recently ruled that the Indian Army can lawfully grant a family pension to a deceased ex serviceman's second wife, even if a formal dissolution of the first marriage did not take place, as long as the first wife does not express interest in the pension. Further, the court specified that if a claim for the family pension is made by the first wife, it must be validated and taken into consideration.
