 In a significant development, the Supreme Court's constitution bench has announced that its 2014 ruling, wherein Section 6A of the Delhi Special Police Establishment Act 1946 was deemed unconstitutional, will be retroactively effective. Essentially, this implies that Section 6A is considered non-operative as of the date it was initially incorporated. For context, Section 6A of the DSPE Act necessitated the Central Bureau of Investigation to gain prior approval from the central government to probe corruption cases involving an officer of joint secretary rank or higher.
