SangsLegal News Arbitrator Appointed by Rajasthan High Court at Jaipur Due to Failure of Friendly Consultation in Resolving Dispute,in Accordance with Agreement.

The Rajasthan High Court at Jaipur recently allowed an application under Section 11 of the Arbitration and Conciliation Act, 1996 to appoint an arbitrator. The application was based on the fact that the Lease Agreement set by both parties included a clause for dispute resolution through 'friendly consultation'. However, the respondent did not partake in or contribute any effort towards the resolution of the dispute via 'friendly consultation'.
