The Supreme has recently ruled that an accused who is already in custody for one case may still seek anticipatory bail for another case. As long as the individual has not been arrested in connection with the second offense, they are eligible to apply for anticipatory bail. Being in custody for one case does not negate the possibility of being arrested for a separate offense.
