SangsLegal News Recent observations by the Supreme Court on reservations and sub classifications within the Scheduled Caste categories


The supreme court recently held that the subdivision of Scheduled Castes is permissible in order to allocate separate quotas for those who are considered more socio-economically disadvantaged within the SC community. States have the authority to identify individuals within the SC category who are more disadvantaged and may subdivide them for a separate quota allocation within the overall quota.
The Supreme Court has further ruled that the 'Creamy Layer' should be excluded from the reservations for Scheduled Castes/Scheduled Tribes.
